Requesting for Revocation
s128 for Overseas Cancellations

Requesting a Revocation of Cancellation

Under Section 128 of the Migration Act, a visa can be cancelled without prior notice if the visa holder is outside Australia. If a visa is cancelled under this section, the Minister must issue a written notice to inform the former visa holder of the cancellation. The reason for visa cancellation may vary under section 116 of the Migration Act 1958.

It may be possible to request a revocation of the cancellation if action is taken within the appropriate timeframe, but is usually 28 days. Requesting revocation of a cancelled visa is a serious matter and will require the need for experienced legal assistance. If your visa has been cancelled while overseas, Kris Ahn Lawyers can provide the guidance you need to request a revocation successfully.
